Common Questions

Frequently Asked

Who is entitled to inherit under Thai law?
Thai law defines statutory heirs in a set order of priority: descendants, parents, siblings, half-siblings, grandparents, and uncles and aunts. A surviving spouse also has inheritance rights, the extent of which depends on which other heirs are present. If a valid Will exists, it may alter these default arrangements — subject to any portion protected by law for certain heirs.
What does an executor actually need to do?
An executor is responsible for gathering and valuing the assets of the estate, settling any outstanding debts, dealing with relevant government offices, and distributing what remains to the heirs. In Thailand this typically involves court appointment as administrator and liaison with the Land Department, financial institutions, and other bodies. The duties can be time-consuming, and our Executor Guidance Service is designed to support you through each stage.
How long does the estate administration process take?
This varies considerably. A straightforward estate with no disputes and clear documentation may be resolved in several months. More complex matters — or those involving formal court proceedings — typically take longer. We provide an honest assessment of the likely timeline early in our engagement, so you know what to expect.
What if family members disagree about the estate?
Disagreements between heirs are not unusual. Depending on the nature of the dispute, they may be resolved through negotiation, mediation, or formal court proceedings. Our Estate Proceedings Representation service covers situations where a more formal path becomes necessary — always with an awareness of the ongoing family relationships involved.
Do I need a lawyer if there is already a Will?
A Will clarifies the deceased's wishes but does not remove the administrative process. Assets still need to be transferred, debts settled, and the appropriate departments notified. In some cases, the validity of a Will may also be questioned. Legal support helps ensure the process is completed correctly and that the Will's provisions are carried out as intended.
What information should I bring to a first meeting?
Bring any documents you have — the death certificate, any existing Will, identification of the deceased and yourself, and a rough list of the assets and debts you are aware of. We can work with incomplete information at the outset; you don't need everything to have a useful first discussion. The initial consultation is about understanding your situation and explaining your options.
